This new issue focusing on the SEAP Region demonstrates that:
- 8% of all ICSID cases involve a State Party from the SEAP Region.
- 62% of these cases invoke a bilateral investment treaty (BIT) and 29% invoke an investment contract between the Investor and the Host-State to establish ICSID jurisdiction.
- 38% of these cases involve the Oil, Gas and Mining Industries and 12% involve the Electric Power and Other Energy Sector.
- 93% were initiated by a juridical person and 7% by a natural person.
- In the cases that were not settled by the parties, but were decided by a tribunal, 71% of such cases resulted in the claims being dismissed on jurisdiction or on the merits.
