​Vol. 31(3) of the ICSID Review is now available online and in print. This is the third special focus issue of the volume that celebrates the 50th anniversary of ICSID and the 30th anniversary of the ICSID Review.

This third special anniversary focus issue, edited by Prof. Chester Brown (University of Sydney, Australia) and Prof. Gabriel Bottini (University of Buenos Aires, Argentina), explores procedural issues in investment treaty arbitration.  Twelve distinguished scholars and practitioners contributed to this issue, the full Table of Contents for which can be found here.

The issue opens with an introduction from the special focus editors underlining the role of procedure in giving effect to the substantive rules of investment law. The first two contributions concern seeking interim relief through provisional measures (in Spanish) and the use of emergency arbitrators prior to final resolution of the dispute. The following two contributions address parallel or competing arbitration or domestic proceedings. The issue then provides an update on the practice surrounding arbitrator challenges in ICSID arbitration and analyses the application of the recently concluded Mauritius Convention and the UNCITRAL Rules on Transparency in Treaty-Based investor–State Arbitration in proceedings. Two further contributions examine evidentiary issues in investment treaty arbitration.  The first considers the use of experts and the second considers the approach of tribunals to evidentiary privileges, including a discussion of the IBA Rules on the Taking of Evidence in International Arbitration and their treatment of legal professional privilege and special political and institutional sensitivity. Finally, the power of ICSID tribunals to terminate proceedings through summary dismissal is examined and an analysis of the ICSID annulment process and discussion on a possible appellate body for investment treaty claims concludes the special focus issue.
