​ICSID has periodically updated its arbitration and conciliation rules to ensure they best serve all facility users. It last amended its Rules and Regulations in 2006, with innovative provisions that introduced welcome developments to the system.

As announced during the Annual Meeting of the Administrative Council on October 7, 2016, the Centre has begun work on further updating and modernizing the current ICSID Rules and Regulations.

Among other things, the ICSID Secretariat will explore how to simplify the dispute settlement procedure to make it increasingly cost and time effective, while ensuring due process and equal treatment of the parties. One of the guiding principles will be to maintain the balance between the interests of investors and States to ensure continued integrity of the process.

As part of the project, the ICSID Secretariat will conduct surveys and prepare background papers concerning various procedural rules for potential amendment. In the upcoming year, the Centre will be making these background papers and proposed draft amendments available to ICSID Member States and the public, and will seek their feedback in a consultation process.
